1.1. Foxhole Wood: Foxhole Wood and Foxhole Wood Productions, located at Goudvink 3 in Spanbroek, registered with the Chamber of Commerce under number 99959682.
1.2. Course of indefinite duration: A course consisting of lessons, in the broadest sense of the word, that is offered periodically and has no specific end date.
1.3. Course of fixed duration: A course consisting of lessons, in the broadest sense of the word, that is offered periodically over a period with a specific end date.
1.4. Group course: Courses with more than two participants and with a minimum number of participants to be determined per course.
1.5. Duo lessons: Courses with two participants.
1.6. Student: The person taking the lessons.
1.7. Payment Obligor (Legal Representative):1.8. Customer: The payment obligor/legal representative of the student.
1.9. Minor: A person under the age of 18.
1.10. Lesson Duration: The time a lesson takes, expressed in minutes or hours.
1.11. Tuition Fee: The value of a product to be purchased by the customer.
2.1. The agreement between Foxhole Wood and the student is formed by and at the moment Foxhole Wood receives a completed registration form by mail, email, or the website.
2.2. For minors, the registration, which establishes the agreement, must be done by a parent or guardian.
2.3. After the agreement has been concluded, the student will receive confirmation by email.
2.4. By signing a registration form or digitally submitting the registration form in one of the ways mentioned above, the student agrees to (the applicability of) these general terms and conditions and to the provision of the lessons by Foxhole Wood.
2.5. The student has the right to cancel the agreement without giving reasons for a period of fourteen days after the date on which the agreement ("distance") to attend a course is concluded.
2.6. No right of cancellation pursuant to Art. 2.5. A lesson is deemed to be cancelled if Foxhole Wood has begun a lesson with the express consent of the student (which consent may be demonstrated, for example, by their actual participation, but is not limited to it) before the fourteen-day period has expired. In that case, cancellation is possible until the moment of the aforementioned consent.
2.7. For individual and duo lessons, placement will be determined in consultation between the instructor and the student, taking the student's stated preferences into account as much as possible. However, no rights can be derived from this.
2.8. In the event of interim registration and placement, the first day of the course will be decisive for the (proportional) calculation and determination of the tuition fee.
2.9. Students who cannot be placed at the start of a course will be placed on a waiting list. If a placement opportunity arises during the school year, Foxhole Wood will contact the student in question.
2.10. In the event of insufficient participation in group courses and duo lessons, Foxhole Wood may cancel courses. A student's departure after the start of a course may also result in insufficient participation, which in some cases will lead to cancellation. Any costs incurred will then be deducted from the number of lessons given.
3.1. Tuition fees are payable by bank transfer.
4.1. Fees are determined by Foxhole Wood and are fixed.
5.1. For courses of indefinite duration, the student commits to participating in the course for an indefinite period (see definition in Article 1). A one-month cancellation period applies to students who do not wish to continue with the lessons. Cancellations must be submitted to Foxhole Wood by email.
5.2. For fixed-term courses, the student agrees to pay for the entire agreed-upon duration of the course (see definition in Article 1). Participation in fixed-term courses cannot be cancelled prematurely; in any case, the tuition fee for the entire agreed-upon duration remains due.
6.1. Course Duration: The duration varies per course offered, according to the information provided in the course description.
6.2. There are no lessons during school holidays and public holidays. The school holidays used by Foxhole Wood are the same as the school holidays established at the national level.
6.3. If it turns out that, due to cancelled lessons due to Foxhole Wood's fault, the student was not offered the minimum number of lessons to which he or she is entitled, the student is entitled to a pro-rata refund for the number of missing lessons.
6.4. If an agreed-upon lesson is cancelled, the student will receive a one-time notification by email to the email address registered with Foxhole Wood.
7.1. If the group size decreases during the school year, Foxhole Wood reserves the right to merge groups or adjust the lesson duration pro-rata.
7.2. Changes in group size and/or lesson duration do not affect the fee. Foxhole Wood may, however, decide to cancel the lessons and refund the fee paid.
7.3. Foxhole Wood reserves the right to change the lesson time and location during the course, without this entitling Kaliber to any reduction in tuition or any other compensation.
7.5. Foxhole Wood reserves the right to engage instructors other than those listed in the program, without this entitling Kaliber to any reduction in tuition or any other compensation.
8.1. Foxhole Wood is not liable for theft, damage to, or the disappearance of property and goods belonging to students and visitors.
8.2. Foxhole Wood is not liable for any material or immaterial damage, either direct or indirect, nor for any consequential damage resulting from participation in one or more products provided by Foxhole Wood.
9.1. Foxhole Wood uses images of students for promotional purposes. Due to the regulations regarding the General Data Protection Regulation, we do our best to protect your privacy as best as possible. The publication of images in which people are clearly recognizable for promotional purposes always takes place with the consent of the person depicted (or, in the case of a child under 16, with the consent of the child's parent/guardian). Consent given can be withdrawn at any time, and the images will then be removed.
10.1 Foxhole Wood processes personal data within the framework of the General Data Protection Regulation and uses this data solely for purposes within its own organization. Personal data is always treated confidentially.
10.2 The student or client has the right to access, rectify, and object to the personal data processed about them and can contact the data protection officer at Foxhole Wood at info@foxholewood.com for this purpose.
11.1. In cases not provided for in these General Terms and Conditions, the management of Foxhole Wood shall decide.
11.2. Any invalidity or voidability of any provision of these General Terms and Conditions shall not affect the validity of the agreement and all other general terms and conditions. The invalid provision shall be deemed to be replaced by a valid provision that, as much as possible, corresponds to the intention of the parties and the meaning the parties could have attributed to the provision when concluding the agreement.
11.3. Foxhole Wood has the right to unilaterally amend these General Terms and Conditions. The latest version of the terms and conditions, as available on the Foxhole Wood website, applies at all times.
12.1. All legal relationships between the student and Foxhole Wood are exclusively governed by Dutch law.
12.2. Disputes arising from this agreement, or concerning the interpretation of this agreement, may be submitted to the management.
12.3. If the dispute is not resolved to the satisfaction of at least one of the parties, either party is free to submit the dispute to the civil court. However, the parties will only appeal to the court after they have made every effort to settle the dispute amicably.
12.4. The (competent chamber) of the Alkmaar District Court has exclusive jurisdiction to hear disputes (including disputes concerning the performance of the agreement(s)), unless the law prescribes otherwise.
